Trademark´s Renewal Terms of protection: 3 Things To Know
1. After the Trademark Law Reform
In the case of a trademark registered as of 01/14/2019, the term of protection begins on the day following the filing of the application and ends at the end of the day corresponding to the day of filing after 10 years later.
An example: application filed on 22.07.2020 – end of protection 22.07.2030.
2. Before the Trademark Law Reform
On the other hand, if it is a trademark registered before 01/14/2019, the 10-year protection period will end at the end of the month in which the filing date falls.
An example: application filed on 14.08, 2015 – protection ends on 31.08. 2025.
3. Times of Renewal
Renewal of the trademark is unlimited and theoretically infinite. It is possible to extend the trademark protection for ten years at a time. The extension becomes effective on the day after the expiration of the respective protection period. To renew the trademark, it is sufficient to pay the renewal fee.
The renewal fee is due 6 months before the expiration date of the trademark and can be paid within these 6 months. If the deadline is missed, surcharges must be paid in addition to the renewal fee. A renewal is however possible 6 months after the expiration of the protection period.
